This technical consultation seeks views on the insolvency regime being developed for further education and sixth form colleges.

Why your views matter

The Technical and Further Education Act 2017 sets out the framework for an insolvency regime which applies aspects of existing insolvency law to further education and sixth form colleges in England and Wales.

The insolvency procedures being introduced are based on those relating to companies under the Insolvency Act 1986, and also include a special administration regime designed to protect the interests of learners in the event that a college becomes insolvent.

This consultation seeks views on the technical detail of the insolvency regime and sets out proposals as to how colleges at risk of (or in) insolvency will be dealt with in practice. It also outlines plans to further improve monitoring and support available to colleges in financial difficulty.
